Student Data Protection
Student data carries some of the strongest legal protections of any data category. FERPA in the United States restricts how student education records can be used and disclosed. COPPA adds additional protections for children under 13. State student privacy laws, which are expanding rapidly, add further requirements. AI systems in education must comply with all applicable student privacy regulations, which means strict controls on what student data AI can access, how it can use that data, and where that data is stored or transmitted.
Key governance rules for student data include never sharing student information with third-party services without proper authorization, never using student data for purposes beyond the educational context in which it was collected, maintaining access logs for all AI access to student records, implementing age-appropriate data handling for systems used by minors, and ensuring data retention policies comply with institutional and regulatory requirements.
Academic Integrity
AI in education creates a complex governance challenge around academic integrity. On one hand, AI can be a powerful learning tool that helps students understand concepts, practice skills, and get feedback. On the other hand, AI that does the work for students undermines the educational purpose. Governance should define clear boundaries for how AI is used in academic contexts. This includes rules about which assignments or assessments permit AI assistance, what level of AI involvement is appropriate for different learning activities, how AI-assisted work should be disclosed, and how to detect and address misuse of AI for academic dishonesty.
Age-Appropriate AI Interactions
AI systems that interact with minors need governance rules tailored to the age group. For younger students, AI should use age-appropriate language, avoid complex or potentially upsetting content, and never collect personal information beyond what is strictly necessary for the educational function. For older students, AI can engage more deeply but still needs boundaries around sensitive topics, data collection, and persuasion techniques. All AI interactions with minors should be monitorable by parents and educators.
Faculty and Staff AI Use
Governance should also address how faculty and staff use AI in their professional work. AI can help with grading, feedback, curriculum development, administrative tasks, and student communication. But each use case needs appropriate governance. AI-assisted grading should be reviewed for bias and accuracy. AI-generated feedback should be checked for appropriateness. AI that communicates with students on behalf of faculty should be transparent about being AI and should follow the same communication standards as human faculty.
Institutional Governance Framework
Education institutions should establish an AI governance committee that includes representatives from administration, faculty, IT, legal, and student affairs. This committee should develop institution-wide AI policies, review and approve new AI applications before deployment, monitor compliance with AI governance rules, respond to AI incidents, and update policies as regulations and technology evolve. Having a cross-functional committee ensures that governance considers all perspectives, from educational effectiveness to legal compliance to student welfare.
